Scope
For all orders and shipments our terms of business and shipping and return policies apply exclusively. Deviating clauses apply only when explicitly confirmed by us. Verbal sub-agreements require our confirmation. In case of typing, display or calculation errors, we are entitled to cancel the contract.
Privacy
We are committed to preserving your privacy and ensuring the security of your transactions.
All the data you need to provide during the checkout process will be transferred through a secure SSL connection.
We promise not to use your data for any other purpose than to facilitate the order. The only third parties with access to your address and payment information are the payment and shipping companies.
Delivery
All orders will be processed as quickly as possible. If we should be unable to ship an item because of delays from our suppliers or other causes outside of our sphere of influence, we reserve the right of partial or subsequent delivery. In such case we will get in touch with you. Since this is a website, FROM aviators FOR aviators, there is the possibility of all of us being out flying at the same time (especially in the summer months). This is not an amazon-type operation with a seemingly unlimited amount of personnel and shipping options (yet).
Pricing
We reserve the right to change prices, promotions, discounts or sales without prior notice. Please note that prices can change frequently, and we cannot offer price protection on any product that has already shipped. We reserve the right to adjust prices for all merchandise due to errors or changing market conditions. All prices quoted are exclusive of taxes, shipping charges and insurance charges where applicable. For details on our shipping rates please visit our Shipping and Returns page. Sales tax only applies for orders to Nevada (Clark county sales tax of 8.1%).
We will not be liable for any lack of availability of products you may order through our website or for any incorrect product specification data that we accept in good faith from our suppliers/manufacturers.
Order Cancellations
We sure don’t want to send it if you’ve changed your mind and don’t want it. So if it hasn’t gone out when we get word from you, we will stop shipment and refund your money. Let us know as early as possible via email providing the following information: First name, last name, order number, description of items ordered, and email address.
This information must accurately match that used with the original order.
Transfer of Funds
In the event of returns or cancellations, funds will be returned to the sender in the same form as submitted to us (or another mutually agreed upon format). Common sense will tell you that we will not send funds back until we have verified that they have been received in good order.
Out of Stock Items
If we have it listed, we normally have it and ship within 3 business days. However, there is the possibility that due to the wild popularity of our stuff there may be a mad rush on one particular item to the point of temporarily depleting our stock. If that should happen, we will make every effort to contact you and allow the option of modifying your order. Otherwise, in the event an item is out of stock at the time of your order, expect shipment within two weeks.
*Note: This policy does not apply to the patches we sell! Please understand that most of these items are collectibles which are not produced by us and we therefore have no control over when they will be available next or even avialable again at all. We ask for your understanding.
Applicable Law
AVIATORwebsite is a Nevada based business. By visiting www.aviatorwebsite.com, you agree that the laws of the State of Nevada, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and AVIATORwebsite.
Severability Clause
If a provision of this agreement is or becomes invalid or illegal or unenforceable it does not affect the validity of any other provisions of this agreement. Both parties of the contract pledge themselves to replace any possibly invalid provision with a solution that is mutually beneficial and diverges from the initially intended deal in the smallest way possible.
